Not Whether or Not Person Lives or Works at Address
In an effort to improve the efficiency of the process serving process, Litigation Supporters, a leading process serving company, is urging its servers to focus on delivering documents to the person named in a citation, regardless of whether or not they live or work at the address.
“The fact that someone lives or works at an address is irrelevant to whether or not they are at the address or can be found at the address,” said Gicela Montoya Jimenez, Operations Manager for Litigation Supporters. “It is important to focus on delivering the documents to the person and ignore statements that are misleading such as ‘They don’t live here…’ or ‘They don’t work here…’ These statements are a ruse and have nothing to do with the presence of a person or whether or not they can be found there.”
The spokesperson added that process servers should be persistent in their efforts to deliver documents, even if they are met with resistance from the person at the address. “If you are told that the person you are looking for doesn’t live or work at the address, don’t give up,” Montoya Jimenez said. “Ask for the person’s contact information and try to serve them that way. You may also want to try serving the documents at a different address, such as the person’s workplace.”
The spokesperson’s comments come as the process serving industry is facing increasing scrutiny. In recent years, there have been a number of high-profile cases in which process servers have been accused of falsifying documents or failing to properly serve people.
